CHAIRMAN BAGOFF: Mr. Plocker. MS. MCGOVERN: It's in the ordinance and nobody objected to the ordinance. That passed. MR. AFRAN: That's got nothing to do with it. The IH ordinance allows an access drive on the property in the IH zone. MS. McGOVERN: It describes it by lot and block. It specifically describes it by lot and block. MR. AFRAN: It can describe all it wants. You can't amend the R-3 by passing elements in the IH. There was no amendment to the R-3 at all. No notice was given that R-3 is being amended and R-3 has never been amended to allow an access road to a multifamily development in the R-3 zone. MS. McGOVERN: I'm just going to disagree with you and we'll agree to disagree. MR. AFRAN: Fair enough. I'm just simply preserving the issue. I didn't want my silence to imply agreement. That's all. CHAIRMAN BAGOFF: Mr. Plocker. MR. PLOCKER: And just for the record, the applicant does disagree with Mr. Afran's legal

And just to note, the two emergency access lots which counsel allowed use in the IH 1 zoning ordinance, those two lots, the applicant provided jurisdictional notice, 200-foot notice, from those two lots in addition to the subject property putting anyone within 200 feet of the two lots for the proposed emergency access to Howell on notice. MR. AFRAN: That may be -- MR. PLOCKER: I just wanted to state that for the record and you may have your own opinion. MR. AFRAN: That may very well be but that notice didn't say -- CHAIRMAN BAGOFF: One at a time. One at a time. MR. AFRAN -- this use will be in the R-3 and that's the point. When you give a notice that says, oh, an access drive in the IH, that's not noticed to people in the R-3 being changed. CHAIRMAN BAGOFF: Okay. We'll take everything under advisement. MR. AFRAN: Thank you. CHAIRMAN BAGOFF: Okay.

And the next regular meeting of the Planning Board will be held Wednesday, October 22, 2025 at 6:30 PM in council chambers. And the special meeting will be held October 29. This meeting, this application will be carried to October 22 with no additional notice to be required. MR. PLOCKER: I just -- I didn't mean to interrupt, Mr. Chairman. I thought there might have been -- are we a special meeting or are we a regular meeting. MS. McGOVERN: October 22 is the regular meeting. MR. PLOCKER: It's a regular meeting. MR. AFRAN: So we're hearing this on October 22? MS. MCGOVERN: Yes. MR. PLOCKER: That wasn't clear to me. I just wanted to make sure. CHAIRMAN BAGOFF: Your person speaks first.
