. The existing dumpsters will be removed/relocated to the proposed 10’ x 10’ enclosure. Sheet C-303 has been added to the plan set to show the circulation of the garbage truck accessing these dumpster locations. 3.7 Two cart corrals are provided adjacent to the Trader Joe’s entrance to server shoppers entering the facility. Where to exiting shoppers place their carts? No corrals are depicted in the parking areas. Sheet C-301 has been revised to provide three (3) cart corrals located within the parking area. The Parking & Loading table has been revised to remove these three parking stalls from the proposed parking count. 3.8 The Applicant shall provide testimony regarding the parking lot striping and whether such will be repainted. One set of directional arrows at the easterly Mt. Pleasant Avenue driveway is proposed to be repainted. Sheet C-301 has been revised to provide a note directing the contractor to re-paint any existing pavement markings that are deemed to be in poor condition as required. 3.9 The Applicant shall provide testimony regarding the intention to install any ground signage, including but not limited to, monument signage, exterior building signage, sign boards, etc. Testimony will be provided regarding ground signage. No ground signage is proposed at this time.

Grading, Drainage and Stormwater Management 4.1 Ordinance 2918-25 adopted on May 20, 2025 classifies this project as a Major Development. Consequently the plan shall address both water quantity and water quality standards. The Stormwater Management proposes to achieve these standards using porous pavement in the reconstructed parking area on the westerly side of the Main Building. However, this stormwater management facility is located within the Flood Hazard Area (FHA) of the West Branch of the Rahway River. The Applicant shall provide testimony as to how this facility will operate and perform when inundated with flood water from the River. Testimony regarding the function of the stormwater management facility during the flooded condition will be provided. 4.2 Since improvements will be constructed within the River’s Flood Hazard Area, permits will be required from the NJDEP. Also the Township, through the Municipal Engineer’s office, shall issue a permit to the Applicant for compliance with the Township’s Stormwater Management Regulations. Proposed improvements on site are permitted by and follow all requirements set forth in the Permit by Rules in NJAC 7:13. Specifically, the Permit By Rules are: Permit-by-rule 8 (7:13- 7.8), Permit-by-rule 39 (7:13-7.39), and Permit-by-rule 40 (7:13-7.40). Submission and review by the New Jersey Department of Environmental Protection is not required per NJAC 7:13- 6.3(a) ‘An activity that meets the requirements of a permit-by-rule may be conducted without prior Department approval’. 4.3 The West Branch of the Rahway River along this parcel’s westerly and northwesterly property line needs to be cleaned of debris and overgrown vegetation. Acknowledged. Debris will be removed from the West Branch of the Rahway River as a condition of approval. 5. Soil Erosion & Sediment Control 5.1 A Soil Erosion and Sediment Control Plan was prepared as part of the site plan submission. This Plan shall be approved by the Hudson Essex Passaic Soil Conservation District. Hudson-Essex-Passaic Soil Conservation District Certification was obtained for the proposed development on September 30, 2025. A copy of this certification has been enclosed within this submission. 5.2 The soil stockpile area appears to

Sheet C-801 has been revised to re-locate the soil stockpile to a portion of parking stalls along the eastern property line, away from the existing storefronts to remain. 6. Site Lighting 6.1 The Applicant shall provide testimony regarding the site’s compliance with Township Ordinance §25-14, related to lighting levels. The Applicant shall review the need for replacement or supplemental lighting to meet the minimum lighting level criteria in §25-14.3 particularly behind the Main Building as well as to its east, while minimizing light spillover onto adjacent properties. Should additional lighting improvements be required, the Applicant shall provide a lighting plan to depict the characteristics of the additional proposed lighting, as well as a photometric analysis to demonstrate compliance with minimum illumination requirements. Additionally, the plan shall be revised to depict any existing light poles on-site that will remain, particularly those that may be behind the building and on the driveway to Pleasant Valley Way.

The proposed site lighting throughout the property has been designed in accordance with the Township Ordinance §25-14.3 where allowable. A variance is requested to provide less than 2.0 footcandles throughout parking areas due to existing site constraints and maximum permitted mounting heights. 7. Landscaping and Buffers 7.1 The Applicant shall provide testimony regarding existing vegetation, and any related removals, replacements, or new planting areas. The Applicant shall also confirm the presence of required buffers as the property abuts residential zones. Testimony regarding the existing vegetation and related removals and replacement will be provided. A total off five (5) existing trees are proposed, three (3) are non-viable and two (2) are viable. To account for the five (5) total trees to be removed, fourteen (14) new replacement trees are proposed, in compliance with §28-8 Tree Replacement of the Township Ordinance. 8. Utilities 8.1 The Applicant shall provide testimony on utility service lines, laterals, connections, or associated appurtenances that are proposed for the new facilities. The Applicant shall clean and televise the existing sanitary lateral and any roof drainage laterals intended to be reused prior to construction. Acknowledged. Cleaning and CCTV inspection will be provided as a condition of approval. 8.2 The Applicant shall provide testimony regarding the need to construct any above- or below grade improvements for utility services. Acknowledged. Testimony regarding above- and below-grade improvements for utilities will be provided. 9. Traffic, Traffic Maintenance and Parking Maintenance 9.1 The Applicant shall provide a Traffic Maintenance and Parking Maintenance Plan depicting how traffic and circulation patterns and parking for those retail facilities that remain will be maintained during the constructions period. Acknowledged. A Traffic Control Plan has been prepared by TPD Inc. and enclosed within this submission. 9.2 Vehicle access, egress and turn restrictions shall remain as previously approved. Acknowledged. 9.3 There appears to be a small inconsistency between the number of parking stalls on the Site Plan and the number of stalls specified in the traffic report. The number of physical parking stalls proposed is 184. Four (4) electric vehicles are permitted to count as double per the Township of West Orange EVSE Ordinance §25-12.6.e.2, bringing the total proposed parking stalls per ordinance to 188.

Inspection Escrow 10.1 The Applicant shall prepare a construction cost estimate for the site improvements for the purpose of computing the amount of funds to be placed in escrow for site inspections. Acknowledged. An Opinion of Probable Construction Costs has been enclosed within this submission. We are in receipt of the Review Memorandum prepared by Walt Kipp, Township Forester, dated November 12, 2025 and offer the following responses: • 4 dead trees along the north side of the building in the rear lot need to be removed. • 2 dead trees on the northeast side of the building along the parking close to Mount Pleasant Place exit need to be removed. Sheets C-201 and L-101 have been revised to note that any existing dead trees located on the subject property are to be removed in coordination with the Township Forester. • Per Township ordinance 28-4e.8, the 50% required canopy coverage for parking lots does not appear to be met on the replanting plan. The Landscape Plan (sheet L-201) has been revised to include additional parking lot tree canopy coverage. A calculation of the required and proposed canopy coverage has also been provided in the Compliance Chart provided on sheet L-201.
