PB-12-28T Rite Aid of New Jersey, Inc. 272 Main Street, West Orange, New Jersey 07052 RESOLUTION OF THE PLANNING BOARD OF THE TOWNSHIP OF WEST ORANGE TECHINCAL REVIEW COMMITTEE Granting technical site plan approval (technical review subcommittee), without variances, for interior store renovations and flood damage repair at 272 Main Street. WHEREAS, the Technical Review Committee of the Planning Board of the Township of West Orange, at a meeting held on November 15, 2012, considered the application for technical site plan approval, without variances, for interior store renovations and flood damage repair on property located in the OB-1 zone, identified as Block 114, Lot 55, which was submitted by Rite Aid of New Jersey, Inc. (the “Applicant”); and WHEREAS, the Technical Review Committee considered the presentation of the Applicant's Construction Manager, and the Applicant's architect; and WHEREAS, a complete application has been filed, all fees required by Ordinance have been paid and it otherwise appears that the jurisdiction and powers of the Technical Review Committee of the Planning Board have been properly invoked and exercised; and the Technical Review Committee of the Planning Board having conducted a vote on this application on November 15, 2012; and WHEREAS, the Applicant requested technical site plan approval, without variances, for interior store renovations and flood damage repair.

NOW, THEREFORE, does the Planning Board (Technical Review Committee) of the Township of West Orange make the following findings of fact and conclusions of law with regard to this application: 1. This is an application for technical site plan approval, without variances, for interior store renovations and flood damage repair. 2. The Board (Technical Review Committee) has recommended and the Applicant has agreed to the following additional conditions of approval: 1. The Applicant shall submit a maintenance plan for the daily, weekly and monthly cleaning of the exterior property. The plan will be submitted at the time of building plan submission; 2. The Applicant to repair fence surrounding the dumpster area; 3. The Applicant to repair pot-holes in the parking lot area ; 4. The Applicant and Township Engineer will review parking lot grading; Applicant will make repairs based on Township Engineer's recommendations. NOW, THEREFORE, BE IT RESOLVED, that this application for technical site plan approval, without variances, for interior office renovations is approved, subject to the additional conditions set forth in this resolution. PROFESSIONAL PLANNER’S REPORT 262 Main Street Realty, LLC & 270 Main Street Realty, LLC 262-270 Main Street / Block 114, Lots 50 & 55 Township of West Orange, Essex County, New Jersey This Professional Planner’s Report has been prepared on behalf of 262 Main Street Realty, LLC and 270 Main Street Realty, LLC, in support of an application for development at Block 114, Lots 50 and 55 in the Township of West Orange, Essex County, New Jersey. The purpose of this report is to evaluate the zoning compliance of the proposed development and to set forth the statutory basis for the granting of the requested variances by the Planning Board. BACKGROUND 262 Main Street LLC (the “Applicant”) is seeking preliminary and final major site plan approval with bulk “c” variance relief from the Township of West Orange Planning Board in connection with a proposal to redevelop an underutilized property along Main Street with a two-story supermarket and associated parking and other improvements. EXISTING CONDITIONS The subject property is designated as Block 114, Lots 50 and 55 on the official tax maps of the Township of West Orange and is commonly referred to as 262-270 Main Street. The subject property is irregularly shaped and has a total area of 30,218 square feet. It features frontage along three streets: 162 feet along Erwin Place, 210 feet along Main Street, and 24 feet along Prospect Place. It generally slopes downward from northwest to southeast. Lot 55 is presently improved with a 1-story brick building (formerly Walgreens) and associated surface parking areas. Lot 50 contains a 1-story former diner and surrounding surface parking areas. The subject property is primarily accessed via two (2) driveways along Main Street and one (1) driveway along Erwin Place. Sidewalks provide access along all three street frontages of the subject property. Chain-link fencing lines the northwestern property line of Lot 50 and borders the driveway along Prospect Place. Properties within the immediate vicinity of the subject property include residential 1-2 family dwellings to the west, and a corner store and garage directly north. The surrounding land use context along Main Street is generally characteristic of a small traditional downtown, with

Surface parking areas are generally located along the side or rear of buildings. A number of NJ Transit bus stops are also provided along the Main Street corridor within proximity of the subject property. The surrounding neighborhood largely consists of lower density residential development (1-2 family). Other notable surrounding land uses include Thomas Edison Historical Park further south and Washington Elementary School to the north.

PROFESSIONAL PLANNER’S REPORT 262 Main Street Realty, LLC & 270 Main Street Realty, LLC 262-270 Main Street / Block 114, Lots 50 & 55 Township of West Orange, Essex County, New Jersey DEVELOPMENT PROPOSAL The Applicant is proposing to demolish most existing improvements except the rear and side walls, and construct a ±13,934 square foot two-story supermarket with 46- off-street parking spaces, inclusive of 5 EV spaces and 2 ADA spaces (of which 1 ADA space is also proposed to be an EV space). The development is also proposed to be served by 10 on-street parking spaces. The existing frontage along Prospect Place will be utilized for 2 of the proposed parking spaces, which will be connected to the proposed main parking area and supermarket via a gravel path. The primary pedestrian entrance to the proposed supermarket building will be along the northern façade, along where shopping carts are proposed to be located. Vehicular access to the proposed development is to be provided via two (2) driveways along Main Street. Additional pedestrian access is proposed via two (2) entry/exit points along Erwin Place. A driveway is proposed along Erwin Place to facilitate loading operations via 1 off-street loading space. A temporary loading space is also to be provided along Main Street between the hours of 7 AM to 11AM Monday through Friday, which will otherwise be used as on-street parking. With respect to other site improvements, the Applicant proposes multiple rain gardens and shade trees within the proposed surface parking area in order to address stormwater management. The development will be illuminated via 3 dark sky compliant LED pole-mounted fixtures within the parking areas as well as via 6 shielded LED wall-mounted fixtures along the perimeter of the proposed supermarket. Utility connections are also proposed for gas, water, and sewer service. The interior of the proposed supermarket will feature two floors. The first floor will include various produce aisles and shelves, a deli and food preparation area, produce storage areas/freezers, restrooms, and sales kiosks. The second floor will consist of storage area which will be serviced by the proposed off-street loading area which ramps upward from Erwin Place. Additionally, the
