Memorandum Page 4 of 6 5. Zoning Review A. Proposed Use: The subject property is located within the R-T Residential Zone wherein private garages and home occupations are permitted accessory uses. The applicant is proposing expansion of the existing detached garage located in the rear yard, to be used for vehicle parking on the first floor and hobby woodworking space on the 2nd floor. Applicant should confirm the detached garage is to be used only for personal use and there will be no business and no additional dwelling unit conducted from the detached garage. The Township of West Orange permits home occupation within the principal building and has few requirements associated with it. This does not appear to be a home occupation, however, testimony clarifying the same should be put forth. Additionally, Board may consider a condition to prohibit any business or residential unit use to be conducted from the garage. If such a situation is to arise, applicant may be required to reapply before the Board. B. Supplemental Provisions for All Districts (§ 25-8): a. No accessory building shall be taller than 1.5 stories or 15 feet. See table below. b. No accessory building shall cover more than 1/3 of the minimum required rear yard. Conforms. Building footprint covers 19% of rear yard. c. No accessory building shall be used as a living or sleeping quarters. Conforms. Building is intended to be used as a woodworking studio and car garage. d. No accessory building shall be located within 15 feet of any principal building, except as otherwise provided in this chapter. Conforms. Proposed garage would be greater than 15 feet from the principal structure. e. No accessory structure, building, storage area, off-street parking area or truck loading space shall be permitted within five feet of a property line. See table below. Accessory structure is within 5 feet of rear property line. However, this is an improvement on the existing condition, which is 10 inches from the property line. C. Bulk Conditions: The following table provides bulk requirements in the R-T Zone and the existing and proposed conditions as noted on the plans. Four (4) variances related to accessory structure height, accessory structure setback, lot coverage, and roof overhang are noted.
