Show all pagesApplicant: Karriem Rhode Property: 13 Porter Rd Block 175.24, Lot 3 4C-1 Strict application of the Zoning Ordinance would result in practical difficulty due to the existing condition of the property. The dwelling is presently constructed with a side yard setback of approximately 6.4 feet from the property line, where 25-7.1 requires a minimum of 8 feet. The proposed addition is designed to align with the existing structure and maintain this established building line. Compliance with the required 8-foot setback would necessitate that the addition be set back from the existing wall, resulting in an irregular and inefficient layout and limiting the reasonable use of the property. The existing setback condition is inherent to the property and was not created by the Applicant. The proposed development will not extend any closer to the property line than the existing structure and will not increase the degree of the existing nonconformity. Accordingly, the requested variance represents the minimum relief necessary to permit a functional continuation and improvement of the existing dwelling. 4E The granting of this variance will not be substantially detrimental to the public good, as the proposed addition does not extend any closer to the property line than the existing structure and therefore does not increase the degree of nonconformity. The existing setback condition has already been established and will simply be continued. The requested deviation is minimal, approximately 1.6 feet from the required setback, and represents no new or increased impact on adjacent properties. The proposed development will not adversely affect light, air, or open space available to adjacent properties, nor will it alter the character of the neighborhood. The addition will remain consistent with the existing scale and placement of the structure.
