123-12 June 26, 2012 RESOLUTION WHEREAS, certain West Orange property owners or their mortgage company have made a duplicate payment for the second quarter 2012 tax; WHEREAS, the Tax Collector of the Township of West Orange has indicated that such Taxpayers or their mortgage company are entitled to refunds to the extent of such overpay-payments; NOW, THERFORE, BE IT RESOLVED by the Township Council of the Township of West Orange that the Tax Collector and Treasurer of West Orange be and they are hereby authorized, empowered and directed to cause to be paid to the taxpayers on the attached list the sums indicated in full and final satisfaction of overpayment of the 2012 taxes. 125-12 June 26, 2012 RESOLUTION RESOLVED by the Township Council of the Township of West Orange, County of Essex and State of New Jersey, that the contract for LICENSED MOTOR VEHICLE DRIVERS FOR MIDTOWN DIRECT SHUTTLE BUS PROGRAM in accordance with the bid documents on file in the Engineering Division, approved by the Township Council, pursuant to an advertisement duly authorized therefore, be and the same is hereby awarded to the below named Bidder. MOBILITY COACH 413 MELROSE WAY MONROE TOWNSHIP, NEW JERSEY 08831 who submitted the lowest responsible bid for Alternate No. 1 in the amount of $262,800.00 for a 24 month period beginning July 1, 2012 and ending June 30, 2014 at a monthly rate of $10,950.00. The rate for any additional services is $21.64 per hour. BE IT FURTHER RESOLVED that the bid for Alternate No. 2, the extension of service from July 1, 2014 to June 30, 2016 in the amount of $11,600.00 per month for a total of $278,400 with an hourly fee of $22.92 be accepted but that formal action on its extension be deferred until early 2014. 126-12 June 26, 2012 RESOLUTION WHEREAS, the Township of West Orange has advertised for bids, pursuant to the New Jersey Local Public Contracts Law (N.J.S.A. 40:A11-1 et seq) for 2012 Llewellyn Park Roadway and Sewer Improvements ; and WHEREAS, the Township Council of the Township of West Orange has considered said bids and has further considered the recommendation of the Township Engineer, the Llewellyn Park Committee of Managers and the Committee of Managers’ Consultant, Jenne Associates LLC, as to the award of said bid; and WHEREAS, the Township Engineer reported that the successful bidder has strictly complied with the bid specifications and is the lowest responsible bidder. NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that the contract for 2012 Llewellyn Park Roadway and Sewer Improvements is hereby awarded to: SANITARY CONSTRUCTION COMPANY 415 FRANKLIN AVENUE ROCKAWAY, NEW JERSEY 07866 In the amount of $3,483,873.00 which is for the Base Bid of $3,355.003.00 and Alternate No. 1 in the amount of $128,870.00. NOW, THEREFORE BE IT FURTHER RESOLVED that Certified Checks and/or Bid Bonds of all except the lowest responsible bidder be forthwith returned, and the Mayor and Township Clerk be and they hereby are respectively authorized to execute and attest a contract for the foregoing. BE IT FUTHER RESOLVED that the award of this contract is contingent upon the expiration of the appeal period for the Bond Finance Ordinance which appropriates the funding for this project without any challenges to the Bond Ordinance. 127-12 June 26, 2012 RESOLUTION WHEREAS , the Township of West Orange operates a Municipal Parking Lot on Mississippi Avenue, Block 142, Lot 32 on the Assessment Maps of the Township; and WHEREAS, Block 142, Lot 32 is owned by New Jersey Transit (NJ Transit); and WHEREAS, the Township of West Orange has leased a portion of Block 142, Lot 32 for a Municipal Parking Lot for over 50 years from NJ Transit and its predecessors Transport of New Jersey and Public Service Coordinated Transport; and WHEREAS, NJ Transit is requesting the renewal of a License Agreement for a five year period commencing August 1, 2012 between the Township and NJ Transit for the use of a portion of Block 142, Lot 32 for a Municipal Parking Lot; and WHEREAS, the initial annual rental fee will increase from $2,070.00 to $2,121.75 with a 2.5 percent annual increase thereafter; and WHEREAS, the Township Engineer reviewed the License Agreement and he advised the Township Council the terms upon which the Township shall maintain and operate the parking lot are acceptable; and WHEREAS, the Township Council desires to continue to operate and maintain this parking lot facility which is vital to the businesses in the Lourdes/Eagle Rock Area. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that it approves the License Agreement between NJ Transit and the Township for a five year period beginning August 1, 2012 at an initial annual rate of $2,121.75 and to increase at 2.5 percent for each year of the License Agreement for the Mississippi Avenue Parking Lot, Block 142, Lot 32 (portion) and that the Mayor is authorized to execute the attached License Agreement and the Clerk attest his signature. 128-12 June 26, 2012 RESOLUTION TO HOLD A CLOSED SESSION WHEREAS, the Open Public Meetings Act (N.J.S.A. 10:4. et seq.) provides for the exclusion of the public meetings of the governing body during the discussion of certain matters; and WHEREAS, prior to the exclusion of the public from a meeting of the Township Council it is required that the Council adopt a Resolution stating the general nature of the subject to be discussed and stating as precisely as possible the time when the minutes of the discussion conducted in closed session can be disclosed to the public; and WHEREAS, this body is about to consider a matter which falls within the purview of N.J.S.A. 10 -4-12, and can properly exclude the public from such discussions; now, therefore, be it BE IT RESOLVED, that the Township Council of the Township of West Orange, now assembled in public session at its regular meeting of June 26, 2012 shall enter into a closed session to consider the following matter(s). () 1. Discussion of any material, the disclosure of which constitutes an invasion of individual privacy.. () 2. A collective bargaining agreement or the terms of provisions of same. () 3.
