129-12 June 26, 2012 RESOLUTION AUTHORIZING THE COLLECTOR OF TAXES TO REBATE PAYMENT TO THE LISTED TAXPAYER PURSUANT TO FINAL JUDGMENT BY THE TAX COURT OF NEW JERSEY WHEREAS, final judgment on tax appeals has been rendered by the Tax Court of New Jersey on the petitions of the taxpayers listed on the attached schedule reducing the assessment for the years 2007, 2008, 2009 & 2010. 132-11 June 26, 2012 RESOLUTION AUTHORIZING THE TOWNSHIP OF WEST ORANGE TAX COLLECTOR TO PREPARE AND MAIL ESTIMATED TAX BILLS IN ACCORDANCE WITH P.L. 1994, c.72 WHEREAS, the Essex County Board of Freeholders and the Township of West Orange have not adopted the Essex County Budget and the Township of West Orange Budget for 2012 and the West Orange Township Tax Collector will be unable to mail the Township’s 2012 tax bills on a timely basis; WHEREAS, the Township of West Orange Tax Collector in consultation with the West Orange Township Chief Financial Officer has computed an estimated tax levy in accordance with N.J.S.A. 54:4-66.3, and they have both signed a certification showing the tax levies for the previous year, the tax rates and the range of permitted estimated tax levies; WHEREAS, in accordance with Chapter 72, P.L. 1994, the Township council requests the Director of Division of Local Government Services to approve the estimated tax levy exceeding 105% listed below. Approval will enable the Township to meet its financial obligations, maintain the tax collection rate, provide uniformity for tax payments and save the unnecessary cost of interest expenses on borrowing. NOW, THEREFORE BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX AND STATE OF NEW JERSEY on this 26th day of June 2012, as follows: 1. The Township of West Orange Tax Collector is hereby authorized and directed to prepare and issue estimated tax bills for the Township for the third installment of 2012 taxes. The Tax Collector shall proceed upon approval from the Director and take such actions as are permitted and required by L. 1994, c.72 (N.J.S.A. 54:4-66.2 and 54.4- 66.3) 2. The entire estimated tax levy for the 2012 is hereby set at $ 202,855,406.39. In accordance with law the third installment of 2012 taxes shall not be subject to interest until the later of August 10 or twenty fifth calendar day after the date the estimated tax bills were mailed. 133-12 June 26, 2012 RESOLUTION AUTHORIZING FUNDING FOR EMERGENCY REPAIRS: JEWISH FEDERATION PLAZA WHEREAS, the Township of West Orange Affordable Housing Program provides affordability assistance in the form of emergency repairs for income-eligible households participating in said Program; and WHEREAS, the Jewish Federation Plaza, constructed in October 1980, is subsidized by HUD for seniors and the disabled and is a prior cycle credit in West Orange’s certified plan; and WHEREAS, due to the age of this development, the commercial kitchen that serves the 134 low income residents is in need of immediate replacement due to energy inefficient appliances, obsolete function and disrepair ; and WHEREAS, a cost estimate for this project of $199,600.00 has been prepared by Steven Weinberg for the Township to undertake the replacement of said commercial kitchen; and WHEREAS, the Township of West Orange wishes to provide funding for the emergency repairs to the commercial kitchen as part of the affordability assistance component of its Affordable Housing Program NOW THEREFORE BE IT RESOLVED by the West Orange Council, County of Essex, State of New Jersey, as follows: 1. The Township of West Orange is hereby committing to utilize funds in the Township’s Affordable Housing Trust Account for a sum not to exceed $199,600.00 for the replacement of the commercial kitchen in the Jewish Federation Plaza, 750 Northfield Avenue, West Orange, NJ 07052 2. 134-12 June 26, 2012 RESOLUTION WHEREAS, pursuant to N.J.S.A. 40:67-23.2 et. seq, commonly referred to as the Municipal Services Act, the Township of West Orange entered into an Agreement with Llewellyn Park entitled “Municipal Services Agreement’ and dated December 23, 2010; and WHEREAS, the Municipal Services Agreement specified the services the Township shall provide Llewellyn Park or the cost of services the Township shall reimburse to Llewellyn Park; and WHEREAS, the Agreement included Leaf Collection from the Park roads as a service and specifies the method for calculating the reimbursement and it also includes the removal of obstruction such as fallen tree limbs as a service; and WHEREAS, there is attached hereto a report of the Township Engineer recommending reimbursement for 2011 Leaf Collection costs to Llewellyn Park in accordance with the formula for reimbursement set forth in the Agreement between Llewellyn Park and the Township as well as the reimbursement for costs associated with the removal of tree debris associated with the October 29, 2011 snow storm that resulted in the simultaneous collection of leaves and tree debris in October, November and December 2011; and WHEREAS, the Township of West Orange wishes to reimburse Llewellyn Park as set forth in the aforementioned report of the Township Engineer. NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that Llewellyn Park, be reimbursed, as set forth therein, on the attached report of the Township Engineer, Leonard R. Lepore, for 2011 leaf collection costs and obstruction removal. BE IT FURTHER RESOLVED that the Township Business Administrator and/or Comptroller issue the appropriate checks to comply with this Resolution as soon as is feasible. KAREN J. 135-12 June 26, 2012 RESOLUTION WHEREAS, the Township of West Orange at the request of the Llewellyn Park Committee of Managers (LPCOM) will make infrastructure improvements in Llewellyn Park entitled “2012 Llewellyn Park Roadway and Sewer Improvements”, and WHEREAS, the Township of West Orange by an Ordinance adopted by the Township Council will make these improvements as a Local Improvement with the costs of the improvements assessed against the benefitting property owners in Llewellyn Park; and WHEREAS, the LPCOM previously obtained the services of Jenne Associates, LLC of 1362 Crim Road, Bridgewater, New Jersey 08807 to design the infrastructure improvements and to prepare specifications and bid documents; and WHEREAS, the Township advertised and received bids for these improvements in accordance with the bid documents prepared by Jenne Associates, LLC dated March, 2012; and WHEREAS, the Township is about to award a contract to Sanitary Construction Company of Rockaway, New Jersey to construct improvements specified in the project 2012 Llewellyn Park Roadway and Sewer Improvements; and WHEREAS, the services of a professional engineer are required during the construction phase to provide construction inspection and contract administration services; and WHEREAS, Jenne Associates, LLC prepared a proposal dated May 3, 2012 to provide construction phase services for a fee not to exceed $270,000.; and WHEREAS, the proposal is acceptable to the Municipal Engineer; and WHEREAS, LPCOM desires Jenne Associates due to their knowledge of the project be retained for the construction phase services; and WHEREAS, the fee of Jenne Associates is considered a project cost that will be assessed against the benefitting property owners in Llewellyn Park; and WHEREAS, the award herein has not been the subject of fair and open bidding pursuant to the Local Public Contracts Law; and WHEREAS, sufficient funds exist in the Capital Budget for this work; and WHEREAS, the Township Council concurs in the foregoing.
