151-25 June 24, 2025 RESOLUTION WHEREAS, an application has been submitted by the Montclair Golf Club, which wishes to sponsor its annual Fourth of July fireworks exhibition at the Montclair Golf Club on Saturday, July 5, 2025 (Rain Date: Sunday, July 6, 2025); and WHEREAS, all of the necessary documentation has been submitted to the Township Clerk, on an Application for Permission to Conduct Fireworks Display (the “Application”), as required by State and local law; and WHEREAS, the Application indicates that Garden State Fireworks, Inc., P.O. Box 403, 383 Carlton Road, Millington, New Jersey, 07946, will provide and supervise the fireworks display; and WHEREAS, the Application has been reviewed and approved by the Township Fire Official, and confirms that a Certificate of Insurance naming the Township as an additional insured has been provided. NOW THEREFORE BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE that the Montclair Golf Club be and is hereby granted permission to conduct a firework display on Saturday, July 5, 2025 (Rain Date: Sunday, July 6, 2025); subject to the directives of the Fire Official, or his designees. 152-25 June 24, 2025 RESOLUTION A Resolution Authorizing the Planning Board to Draft a Redevelopment Plan for Block 88, Lot 1 Pursuant to N.J.S.A. 40A:12A-1 et seq. WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq., provides a mechanism to empower and assist local governments in efforts to promote programs of redevelopment; and WHEREAS, on December 14, 2021, the Township of West Orange (the “Township”) declared the entirety of the Municipality as an Area in Need of Rehabilitation in 2021 (Resolution No. 323-21); and WHEREAS, the Township desires to explore whether the real property located at 80 Main Street, West Orange, New Jersey more commonly known as Block 88, Lot 17 on the Township of West Orange Tax Map, (the “Property” and/or “Study Area”) may be an appropriate for a Redevelopment Plan pursuant to N.J.S.A. 40A:12A-7(f); and WHEREAS, pursuant to N.J.S.A. 40A:12A-7(f), the Township hereby desires to direct the Township of West Orange Planning Board to prepare a Redevelopment Plan after holding a public hearing concerning the Property and reviewing a package of materials appended hereto from the Property’s Ownership concerning the Property and potential permitted uses, rules and standards that would be set forth in a Redevelopment Plan;; and WHEREAS, as part of this process, the Property Owner shall pay into Escrow with the Township in the amount of $15,000.00 within ten (10) days of the adoption of this Resolution and agrees to pay for any and all reasonable costs incurred by the Township of West Orange and Township Planning Board’s professionals in connection with the preparation of a Redevelopment Plan; and
WHEREAS, the Township Council, when considering the proposed Redevelopment Plan after it is referred back to the Township Council pursuant to N.J.S.A. 40A:12A-7(f), may amend or revise any portion of the proposed Redevelopment Plan by an affirmative vote of the majority of its full authorized membership and shall record in its minutes the reasons for each amendment or revision, should it choose to adopt the Redevelopment Plan.; and NOW, THEREFORE, BE IT RESOLVED that the Township Council hereby directs the West Orange Planning Board to prepare a Redevelopment Plan after holding a public hearing concerning the Property and reviewing a package of materials appended hereto from the Property’s Ownership concerning the Property and potential permitted uses, rules and standards that would be set forth in a Redevelopment Plan pursuant to N.J.S.A. 40A:12A-7(f); and BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to the Township Clerk, Chief Financial Officer and Township Planning Board and Planning Board Secretary; and BE IT FURTHER RESOLVED that a copy of this Resolution shall be made available in the Clerk’s office in accordance with applicable law. 153-25 June 24, 2025 RESOLUTION PRESCRIBING FEES AS SET FORTH IN ORDINANCE 2918-25, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 25, SECTION 29 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP AND ESTABLISHING NEW REQUIREMENTS FOR STORMWATER MANAGEMENT WHEREAS, on May 20, 2025, the Township of West Orange (the “Township”) passed Ordinance 2918-25 (the “Ordinance”) on second reading, amending and supplementing Chapter 25, Section 29 of the Revised General Ordinances of the Township related to stormwater management; and WHEREAS, the Ordinance established Chapter 25, Section 29.14 which prescribes fees to be set forth by Resolution for applications for minor and major developments related to stormwater management; and NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, the fees as set forth in § 25-29.14 shall be prescribed as follows: Major and Minor Developments (as defined in the Ordinance) that are part of a Land Use Board Application process shall file a stormwater permit application with the associated application fee of $150. All professional reviews shall be paid for through the escrow associated with the stormwater permit application. For Major Developments that are part of the Land Use Board application, a permit fee in the amount of $3,000, in addition to $175.00 per acre for the size of the lot, shall apply and for Minor Developments that are not part of the Land Use Board application, a fee shall apply in the amount of $750 for the first three (3) professional reviews. Any additional reviews that are required will be at a supplemental fee in the amount of $150 per review. RESOLVED, that the Township Clerk is authorized to attest to the Mayor’s signature.

154-25 June 24, 2025 RESOLUTION AUTHORIZING THE TOWNSHIP OF WEST ORANGE TAX COLLECTOR TO PREPARE AND MAIL ESTIMATED TAX BILLS IN ACCORDANCE WITH P.L. 1994, c.72 WHEREAS, the Essex County Board of Taxation has not certified the General Tax Rate throughout Essex County for 2025 and the West Orange Township Tax Collector will be unable to mail the Township’s 2025 tax bills on a timely basis; WHEREAS, the Township of West Orange Tax Collector in consultation with the West Orange Township Chief Financial Officer has computed an estimated tax levy in accordance with N.J.S.A. 54:4- 66.3, and they have both signed a certification showing the tax levies for the previous year, the tax rates and the range of permitted estimated tax levies; WHEREAS, in accordance with Chapter 72, P.L. 1994, the Township Council approves the estimated tax levy to enable the Township to meet its financial obligations, maintain the tax collection rate, and provide uniformity for tax payments and save the unnecessary cost of interest expenses on borrowing. NOW, THEREFORE BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX AND STATE OF NEW JERSEY on this ___ day of June 2025, as follows: 1. The Township of West Orange Tax Collector is hereby authorized and directed to prepare and issue estimated tax bills for the Township for the third installment of 2025 taxes. The Tax Collector shall proceed and take such actions as are permitted and required by L. 1994, c.72 (N.J.S.A. 54:4-66.2 and 54.4-66.3) 2. The entire estimated tax levy for the 2025 is hereby set at $265,321,592.74, with the estimated tax rate of 2.653. In accordance with law the third installment of 2025 taxes shall not be subject to interest until the later of August 10 or twenty fifth calendar day after the date the estimated tax bills were mailed. The estimated tax bills shall contain a notice specifying the date on which interest may begin to accrue.
