268-25 November 24, 2025 RESOLUTION WHEREAS, for many years Montclair Golf Club (the “Club”), located at 25 Prospect Avenue, West Orange, New Jersey 07052, has arranged for Santa Claus to arrive to meet the Club members and their guests in attendance for a holiday celebration; and WHEREAS, this year’s annual Santa Claus events are scheduled for: (i) Sunday, December 7, 2025 at approximately 11:00 a.m.; and (ii) Sunday, December 14, 2025 at approximately 11:00 a.m., and WHEREAS, unfortunately, Santa’s reindeer, Rudolph et al., are not available for the trip at this time of year as they must be well-rested in preparation for their big Christmas Eve event; and WHEREAS, Santa Claus has again graciously managed to make arrangements to travel by small helicopter to attend the Club’s annual holiday celebration; and WHEREAS, the New Jersey Department of Transportation, Division of Aeronautics, Inspection & Aircraft Operation, not wanting to be Scrooge-like, does permit and has in the past permitted helicopter landings such as these on country club property when approved pursuant to its application process; and WHEREAS, Dennis Lever, the helicopter pilot and agent for the Club, will prepare the required Application for Temporary Aeronautical Facility License for submission to the New Jersey Department of Transportation, and which must be accompanied by, among other documents and things which the Club will provide, a “letter, statement, or certificate from the appropriate governing body which states there is no objection to the issuance of a temporary license (mandatory for all temps)”; and WHEREAS, the Club shall name West Orange as an additional insured for no less than Two Million Dollars ($2,000,000) for each occurrence of transportation of Santa Claus by helicopter to the Club on the dates referenced herein; and WHEREAS, if the date(s) of Santa’s arrival needs to be moved or changed for any reason, including but not limited to weather conditions, the Club shall have permission from the Township for the Deleted: 232-25 Deleted: October 28,
new dates so long as the Township Police Department and Township Fire Department are advised at least two (2) business days in advance of Santa’s newly scheduled arrival; and Deleted: . Township of West Orange Essex County, New Jersey 269-25 Resolution: Approval to submit a grant application and execute a grant contract with the New Jersey Department of Transportation for the Woodland Ave, Forest Ave, McCluskey Ct, Harper St Improvements Project NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of West Orange formally approve the grant application for the above stated project. BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an electronic grant application identified as “LTPF-2026-Woodland Ave, Forest Ave, McCluske00037” to the New Jersey Department of Transportation on behalf of the Township of West Orange. BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant agreement on behalf of the Township of West Orange and that their signatures constitute acceptance of the terms and conditions of the grant agreement and approve the execution of the grant agreement. 270-25 November 24, 2025 RESOLUTION TO HOLD A CLOSED SESSION WHEREAS, the Open Public Meetings Act (N.J.S.A. 10:4. et seq.) provides for the exclusion of the public meetings of the governing body during the discussion of certain matters; and WHEREAS, prior to the exclusion of the public from a meeting of the Township Council it is required that the Council adopt a Resolution stating the general nature of the subject to be discussed and stating as precisely as possible the time when the minutes of the discussion conducted in closed session can be disclosed to the public; and WHEREAS, this body is about to consider a matter which falls within the purview of N.J.S.A. 10-4-12, and can properly exclude the public from such discussions; now, therefore, be it BE IT RESOLVED, that the Township Council of the Township of West Orange, now assembled in public session at its regular meeting of November 24, 2025 enter into a closed session to consider the following matter(s). 271-25 November 24, 2025 A RESOLUTION APPROVING A PROPOSAL FROM MATRIX NEW WORLD FOR ENVIRONMENTAL SERVICES AT ROCK SPRING GOLF CLUB LOCATED AT 90 ROCK SPRING ROAD NTE $49,800.00 WHEREAS, on November 13, 2025, the Township of West Orange (the “Township”) received a proposal from Matrix New World Engineering, Land Surveying, and Landscape Architecture, P.C. (“Matrix”) to perform environmental services at: 90 Rock Spring Road known as the Rock Spring Golf Club, West Orange, New Jersey, also known as Block 160-Lots 2 & 10, Block 1601.01-Lots 30 & 34 and Block 46.01-Lot 22 on the Township of West Orange Tax Map; and WHEREAS, the New Jersey Department of Environmental Protection (NJDEP) approved a grant to the Green Acres Program for the Rock Spring Golf Club; and WHEREAS, part of the requirements of the procedural process was for the Township to submit a copy of the Response Action Outcome (RAO) for which a Licensed Site Remediation Professional (LSRP) is required; and WHEREAS, the work will consist of Matrix conducting the various tasks outline in their proposal for the issuance of the RAO; and NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Township accepts the proposal from Matrix attached herein as Exhibit “A,” not to exceed $49,800.00 to complete the scope of work; AND FURTHER RESOLVED, that a copy of this Resolution shall be made available in the Clerk’s office in accordance with applicable law. (Matrix) is pleased to provide this proposal to the Township of West Orange (Township) for the performance of Environmental Services for the above-referenced property (Site) located in West Orange, New Jersey. SITE BACKGROUND The approximately 137.92-acre Site is currently operated as a country club and 18-hole golf course. The Site is bordered by Northfield Avenue to the north, residences to the east and south, and park space and residences to the west. The golf course was established and has been in operation since 1925. In February 2019, Matrix prepared a Preliminary Assessment Report (PAR) for the Site. As a result of the PAR, 14 Areas of Concern (AOCs) were identified throughout the Site, of which further investigation was recommended for two (2) AOCs including: • • AOC-2 – Former Underground Storage Tanks (USTs), and AOC-11 – Historic Fill Material In December 2024, the New Jersey Department of Environmental Protection (NJDEP) approved Green Acres Grant funding for the Site to the Township. As required by the Green Acres rules, N.J.A.C. 7:368.2, AOCs identified during completion of a PAR must be addressed to the NJDEP’s satisfaction prior to disbursement of any funding associated with the Green Acres Grant program. Additional information was provided to Green Acres Grant program with regards to AOC-2 as the former USTs were closed out with the NJDEP and a Groundwater Remedial Action Permit (RAP) has been approved by the NJDEP for the benzene, MTBE, and TBA groundwater impacts associated with the former USTs. As a result of the Green Acres review of the February 2019 PAR prepared for the Township, the NJDEP indicated that further investigation is required to address the potential historic fill material (HFM) (AOC11)

In September 2025, Matrix completed site investigation (SI) activities to address the HFM AOC and to continue the required groundwater monitoring program associated with the approved groundwater RAP. During the investigation, no HFM was identified, and benzene was detected below the applicable NJDEP groundwater quality standards. Below is the scope of work recommended to close out the AOCs for the Site based on the September 2025 investigation activities. PROPOSED SCOPE OF SERVICES The proposed work will be completed in accordance with the Site Remediation Reform Act (SRRA), N.J.S.A 58:10C-1 et seq., the Administrative Requirements for the Remediation of Contaminated Sites (ARRCS), N.J.A.C. 7:26C, the Technical Requirement for Site Remediation (TRSR), N.J.A.C. 7:26E, and the NJDEP’s Historic Fill Material Technical Guidance document (April 2013). Task 1 – LSRP Retention In accordance with the SRRA, ARRCS, and the TRSR, Matrix will submit the Licensed Site Remediation Professional (LSRP) Retention Form via the NJDEP Online Portal. In addition, in accordance with the TRSR, the person responsible for conducting the remediation of a contaminated site is required to perform public notification and outreach. Matrix will prepare and post a Public Notification sign and submit a revised public notification form to the NJDEP. Task 2 – Confirmatory Groundwater Sampling Event Based on the September 2025 groundwater sampling event, benzene was identified at concentrations below the applicable NJDEP Groundwater Quality Standards (GWQS) and not an order of magnitude above the current February 2025 NJDEP GWQS at monitoring well, MW-3. Pursuant to the NJDEP guidance, a minimum of two (2) consecutive rounds of groundwater sampling, conducting at least three (3) months apart, are required to demonstrate that groundwater impacts have been remediated or are no longer present. Matrix recommends the completion of one (1) additional sampling event for monitoring well MW-3 to further evaluate groundwater quality and confirm that residual benzene impacts have been removed at the Site. Matrix proposes the completion of a groundwater sampling event for monitoring well MW-3 in December 2025 to confirm the finding from the September 2025 groundwater sampling event. The groundwater sampling event will include sample collection from one monitoring well (MW-3) as the other nine monitoring wells have illustrated two consecutive clean rounds in the past for benzene, MTBE, and TBA. Prior to purging and sampling, the static groundwater level in each monitoring well will be measured and recorded. The monitoring well will be purged and sampled using the NJDEP-approved volume average purging (VAP) and sampling methodology. Purge water will be filtered through a carbon filter bucket prior to discharge to the surface. One (1) groundwater sample will

One (1) groundwater sample will be collected from monitoring well MW-3. The groundwater samples will then be sent to a NJDEP certified laboratory to be analyzed for benzene. The sample will be analyzed on a standard two (2) week turnaround time. The groundwater sampling event is anticipated to be completed in one (1) day. Upon receipt, the groundwater sampling results will be compared to the NJDEP GWQS and the interim groundwater quality criteria. Task 3 – Update and submission of the Site Investigation Report to the NJDEP Matrix had previously prepared a Site Investigation (SI) Letter Report for the work that was completed in September 2025 at the Site. In this task, Matrix will compile the results from the site investigation activities into a Site Investigation Report (SIR) which will include the upcoming December 2025 sampling event (task 2). The SIR will include a summary of the sampling results demonstrating that no HFM was observed during the advancement of the soil borings, the findings from the two groundwater sampling events, an order of magnitude analysis, the well decommissionings, and findings and recommendations. Upon completion, a draft SIR will be submitted to the Township for review. Comments provided by the Township will be incorporated into the final SIR and the SIR will be submitted through the NJDEP online portal along with a Case Inventory Document (CID), which provides a summary of identified AOCs and the associated NJDEP forms including an Receptor Evaluation (RE).
