22. 23. MAINTENANCE AND PROTECTION OF TRAFFIC The Contractor shall plan and carry out his work to provide for the convenient and safe passage of both vehicular and pedestrian traffic through the worksite area and along all detours if necessary. As noted on the Construction Plans, the road will be permitted to be closed from 8:00 a.m. to 5:00 p.m., Monday through Friday. The Contractor shall furnish, erect or place, and maintain, in good condition, barricades, signs, lights, traffic cones, barrels and pavement markings, and other warning and danger signals and devices, appropriate and adequate for the specific needs and subject to the Engineer's approval, at working sites, closed roads, intersections, open excavations, locations of material storage, standing equipment and other obstructions, at points where the usable traffic width of the road is reduced, at points where traffic is deflected from its normal courses or lanes, and at other places of danger to vehicular or pedestrian traffic or to completed work. This plan shall be reviewed and subject to approval by the Engineer. No outside employment job can be accepted without pre-payment of all necessary fees. If for unknown reasons the officers must work past the time requested, you will be billed for the extra time. When the officer works less than the time requested and you have pre- paid all fees required, you will be issued a refund. COORDINATION WITH TOWNSHIP OPERATIONS The Contractor shall perform his work so as not to disrupt the day to day use of the facilities, The work shall be coordinated with the Maintenance Supervisor who is to be notified in advance of specific work items that the Contractor will perform. SUPPLEMENTAL SPECIFICATIONS
STANDARD SPECIFICATIONS The Standard Specifications of the New Jersey Department of Transportation for Road and Bridge Construction dated 2019 as amended and augmented by the Supplementary Specifications shall govern the construction of this project and the execution of the Contract. The attention of the bidders is specifically directed to provisions of such Specifications, which are hereby made a part hereof, as if fully set forth at length. DIVISION 100 — GENERAL PROVISIONS SECTION 101 — GENERAL INFORMATION 101.03 TERMS THE FOLLOWING TERMS ARE CHANGED. actual cost: The computed cost using calculations of direct labor, labor fringe benefits, indirect labor costs, insurance, materials, extraordinary expenses, equipment, profit, overhead, and subcontractors. SECTION 103 — AWARD AND EXECUTION OF CONTRACT 103.04 EXECUTION OF THE CONTRACT THE FIRST PARAGRAPH IS REPLACED WITH THE FOLLOWING: The Contract will be mailed to the successful bidder upon intent to award. The Contract shall be signed by the successful bidder and returned together with the Performance Bond, Payment Bond, and the appropriate Certificates of Insurance prior to the date of award of the Contract. The Contract will be signed by the Township on the date of award of the Contract. The Contract shall not be considered as effective until it has been fully executed. 103.06 FAILURE TO EXECUTE CONTRACT CHANGE THE LAST SENTENCE IN THE SECOND PARAGRAPH TO: The filing of such notice has the same force and effect as the failure of the Bidder to execute the Contract and furnish a performance bond, payment bond, and certificates of insurance within the time specified in Section 103.04. SECTION 104 — SCOPE OF WORK 104.01 INTENT ADD THE FOLLOWING: The work to be performed under this contract shall include: 104.03 CHANGES TO THE CONTRACT 104.03.03 Types of Changes 3. Changes in the Character of Work. THE FOLLOWING IS ADDED AFTER THE THIRD PARAGRAPH For Differing Site Conditions: 1.N.J.S.A. 40A:11-16.7 shall govern a changed site condition for all construction contracts issued by the Township of West Orange. 2. In accordance with N.J.S.A. 40A:11-16.7 (d.4) the Township of West Orange has set a limitation of 10% for both profit and overhead as applicable for quantities above 120% of the original bid. SECTION 105 — CONTROL OF WORK 105.01.01 RE DELETE THE LAST SENTENCE IN THE SECOND PARAGRAPH AND THE ASSOCIATED LIST OF ITEMS. 105.01.02 Inspection DELETE THE SECOND PARAGRAPH AND REPLACE WITH THE FOLLOWING: Each part or detail of the Work is subject to inspection by the RE. If the RE determines that any Work requires special inspection, testing, or approval not specified in the Contract, the RE will perform such inspection, testing, or approval using Township services, by contracting with others for such services, or by instructing the Contractor to order special inspection, testing, or approval. If such special inspection or 6
testing reveals a failure of the Work to comply with the requirements of the Contract, or with respect to the performance of the Work, with laws, ordinances, rules, regulations, or orders of any public authority having jurisdiction, the Contractor shall bear all costs thereof, including the Township's additional services made necessary by such failure. If tests reveal no such failure, the Township will bear such costs, and a Supplementary Agreement will be negotiated. 105.04 PLANS AND SPECIFICATIONS DELETE THIS SUBSECTION IN ITS ENTIRETY AND REPLACE WITH THE FOLLOWING: The Contract Documents are essential parts of the Contract, and a requirement occurring in one is as binding as though occurring in all. All components are complementary and describe and provide for the general completion of the Project. The Contractor shall keep one set of Plans, Standard Specifications, Supplemental Specifications and General Provisions, and Standard Details available on the Project site at all times. In case of discrepancy, calculated dimensions will govern over scaled dimensions; Plans will govern over Specifications; Contract Documents will govern over Working Drawings, Right-of-Way Plans will govern over Plans when setting monuments; and Supplemental Specifications will govern over Standard Specifications. 105.07 COOPERATION WITH UTILITIES 105.07.01 Working In The Vicinity Of Utilities A. _ Initial Notice. THE FOLLOWING IS ADDED: Bidders are advised to verify the above information as its accuracy and completeness is not guaranteed by the Township. E. Damage. THIS SUBPART IS REPLACED WITH THE FOLLOWING: The Contractor shall protect, support, and secure all in-place utility facilities so as to avoid damage to them and any interruption of service. The Contractor shall not temporarily move existing or completed utility facilities without the Utility(s) written consent, and the facilities shall be as safe and permanent at completion as they were before the Contractor's involvement. In the event the Contractor damages a utility facility, including property service connections, the Contractor shall notify the Utility(s) immediately. The Utility(s) may complete the repairs or allow the Contractor to complete the repairs, with the Contractor responsible for any applicable time and expense.
