265-26 September 29, 2026 RESOLUTION WHEREAS, by Resolution No. 79-26 dated February 24, 2026, the Township Council awarded the Contract for the Oscar Schindler Performing Arts Center Structural Improvements Project to MT Contractors, LLC., 490 Riverview Drive, Suite 6, Totowa, New Jersey, in the amount of $235,150.00; and WHEREAS, the work under this contract included structural improvements to the Oskar Schindler Performing Arts Center (OSPAC), including, but not limited to, expansion of the existing stage, relocation of the stage stairs, installation of a storage shed, window guards, and related improvements; and WHEREAS, by letter dated September 10, 2026, the Municipal Engineer recommended approval of the Final Accounting of As-Built Quantities for this project in the amount of $25,955.74, an 11.04 percent increase over the previously authorized contract amount; and WHEREAS, the increase is due to supplemental items S-1 through S-10, including, but not limited to additional; stage repairs, repairs to an existing shed, fencing, masonry, and speaker pole adjustments not included in the original contract but required to complete the project; and WHEREAS, sufficient funds exist for this additional work; and WHEREAS, this contract provided that modifications to the agreement may be made by a signed writing by both parties entitled “Amendment to Agreement;” and WHEREAS, the Bid Specifications permitted changes in the work under Article 10, which provided for allowing additions, deletions, or revisions in the work by Change Order; and WHEREAS, the Township Council concurs in the foregoing.
