101-12 May 29, 2012 RESOLUTION WHEREAS, the Township of West Orange (the “Township”) owns a certain outdoor pool facility including locker rooms at or around 60 ½ Cherry Street within the Township (the “Pool Facilities”); and WHEREAS, the Montclair YMCA desires to use the Pool Facilities during certain limited hours for swim practices during the Summer of 2012; and WHEREAS, the Legal Department has drafted a License Agreement for limited use of Pool Facilities; and WHEREAS, the use shall not conflict with the Township’s uses; and WHEREAS, the Montclair YMCA shall comply with all pool regulations and all applicable laws; NOW, BE IT HEREBY RESOLVED, BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE that the Mayor be and hereby is authorized to enter into the annexed License Agreement for limited use of Pool Facilities; and it is further RESOLVED, that the entry of the License Agreement shall be subject to the Licensee’s providing proof of adequate insurance with the Township named as an additional insured, subject to approval of the Law Department.
