176-22 July 19, 2022 RESOLUTION APPROVING THE APPOINTMENT OF TAX COLLECTOR WHEREAS, N.J.S.A. 40A:9-142 requires that every Municipal Tax Collector shall hold office for a term of four (4) years, or, in the case of a vacancy for the remainder of the unexpired term; and WHEREAS, the Township of West Orange has a vacancy in the Tax Collector position, a term which expires December 31, 2025; and WHEREAS, it is the desire of the Governing Body that Kathy Longo be appointed as Tax Collector for the Township of West Orange, commencing July 1, 2022 for the remainder of the unexpired term; and BE IT RESOLVED by the Governing Body of the Township of West Orange, New Jersey that Kathy Longo is hereby appointed as Tax Collector of the Township of West Orange for the remainder of the unexpired term commencing July 1, 2022 as per N.J.S.A. 40A:9-142; and BE IT FURTHER RESOLVED by the Governing Body of the Township of West Orange, New Jersey that the compensation for this appoint be consistent with the salary ordinance in effect for the position of Tax Collector during the period of the unexpired term. 178-22 July 19, 2022 RESOLUTION WHEREAS, NJSA 54:5-19.1 authorizes electronic tax sales pursuant to rules and regulations to be promulgated by the Director of the Division of Local Government Services, and WHEREAS, the Director of the Division of Local Government Services has approved NJ Tax Lien Investors/Real Acuction.com to conduct electronic tax sales, and WHEREAS, an electronic tax sale is innovative and provides a greater pool of potential lien buyers, thus creating the environment for a more complete tax sale process, and WHEREAS, the Township of West Orange wishes to participate in an electronic tax sale. NOW THEREFORE, BE IT RESOLVED, by the Township Council of the Township of West Orange, New Jersey, that the Tax Collector is hereby authorized to participate in the electronic tax sale and submit same to the Director of the Division of Local Government Services if necessary. 179-22 July 19, 2022 RESOLUTION AUTHORIZING THE ISSUANCE OF A DUPLICATE TAX SALECERTIFICATE PURSUANT TO N.J.S.A. 54:6-52.1 WHEREAS, the Tax Collector of this municipality has previously issued a Tax Sale Certificates to Trystone Capital Assets, LLC which certificates are dated December 10, 2021 covering premises commonly known and referred to as Block 113.02 Lot 83 as set out on the municipal tax map then in use which certificate bears number #21-036 Block 155.22 Lot 42.01 C0178 as set out on the municipal tax map then in use which certificate bears number #21-070. WHEREAS, the purchaser of the aforesaid tax sale certificate has indicated to the Tax Collector that they have lost or otherwise misplaced the original tax sale certificate and have duly filed the appropriate Affidavit of Loss with the Tax Collector, a copy of which is attached hereto. NOW THEREFORE, be it resolved by the Mayor and Governing Body of the Municipality of the Township of West Orange that the Tax Collector of the municipality be and is hereby authorized, upon receipt of the appropriately executed and notarized Loss Affidavit, to issue an appropriate duplicate tax sale certificate to the said purchaser covering the certificate lost as previously described all in accordance with the requirements of Chapter 99 of public Laws of 1997. BE IT FURTHER RESOLVED that a copy of this Resolution and the Loss Affidavit be attached to the duplicate certificate to be issued to said purchased and that said duplicate certificate shall be stamped or otherwise have imprinted upon it the word “Duplicate” as required by law. 180-22 July 19, 2022 RESOLUTION WHEREAS, certain tax appeals in 2017 are pending concerning the Properties enumerated herein; and WHEREAS, Hendricks Appraisal Company, LLC (“Hendricks”) has been asked to conduct two (2) primary types of appraisal reports: (i) Appraisal Report; and (ii) the Restricted Appraisal Report pursuant to a professional services agreement for appraisal services for Tax Year 2017; and WHEREAS, Hendricks has agreed to provide appraisal services for the tax year 2017, pursuant to the terms and conditions set forth in the agreement annexed hereto as Exhibit “A” for the following properties (“Properties”): ADDRESS BLOCK LOTS 10 Rooney Circle 155 41.02 100 Executive Drive 155 40.02 200 Executive Drive 155 42.02 300 Executive Drive 155 42.01 and WHEREAS, all fees for such services will be paid in full by West Orange Office Executive Park, LLC (“WOOEP”) former owner of the Properties; and WHEREAS, this engagement is not done under the fair and open process set forth in the applicable laws; NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Mayor be and is hereby authorized to execute an agreement, in the form annexed hereto, to retain Hendricks to provide appraisal services at the sole cost and expense of
West Orange Office Executive Park, LLC, former owner of the Properties, on the terms and conditions set forth therein; and it is further RESOLVED that notice of this award shall be available in the Clerk’s office in accordance with applicable law. 181-22 July 19, 2022 RESOLUTION WHEREAS, West Orange Office Executive Park, LLC (“WOOEP”) formerly owned four (4) properties in the Township known as 100 Executive Drive, 200 Executive Drive, 300 Executive Drive and 10 Rooney Circle (“Properties”); and WHEREAS, WOOEP agreed that it is solely responsible for any refund concerning the 2017 tax appeals which are pending; and WHEREAS, Renaud DeAppolonio LLC has agreed to provide professional services for certain pending litigation involving 2017 tax appeals pursuant to the terms and conditions set forth in the agreement annexed hereto as Exhibit “A” at WOOEP’s sole cost and expense; and WHEREAS, this engagement is not done through the open and fair process for professional services; and WHEREAS, pursuant to pursuant to N.J.S.A. 40A:11-5(1)(a)(i), the proposed professional services contract is subject to an exception to the standard bidding procedures set forth in the Local Public Contracts Law; NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Mayor be and is hereby authorized to execute an agreement, in the form annexed hereto, to retain Renaud DeAppolonio LLC for the enumerated tax appeal services for tax year 2017. Such services shall be paid solely by West Orange Office Executive Park, LLC, former owner; the Municipal Clerk shall be and hereby is authorized to attest to the Mayor’s signature; and it is further
