Public Meeting- March 10, 2015 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 7:00 P.M Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 4, 2014. Roll Call: Present: Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Guarino Absent: None The Township identified and presented for unanimous consent, Item 7 (Bills) and Item 8 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Mark Meyerowitz, 19 Howell Drive, West Orange There was no one else who wished to be heard and the public hearing was closed. Bills The Bill List was received and ordered paid. A Summary of the Bill List is attached. Resolutions The following resolutions were adopted: Resolution #75-15 Resolution Appointing Leonard R. Lepore and James A. Resolution #95-15 Resolution Authorizing an Agreement with Fairview Insurance Associates to Provide Risk Management Consulting Services to the Township for the Period of January 1, 2015 through December 31, 2015 *It is noted that Councilman Cirilo recused himself from the above resolution. Resolution #96-15 Resolution Awarding the Contract for the 2015 Road Improvements, Phase 1 Various Streets – High Street, Orange Place, Granada Construction Corp., 147 Thomas Street, Newark, NJ 07114, in the Amount of $681,898.00 Subject to Federal Clearance of the Contractor by the Essex County Division of Housing and Community Development Resolution #97-15 Resolution Awarding an Emergency Contract Between the Township and Rapid Pump and Meter Service Co, Inc. of P.O. Box AY, 285 Straight Street, Paterson, New Jersey 07509 for Emergency Bypass Pumping at the Northfield Avenue Pump Station in the Amount of $53,919.16 to Supply and Install Temporary Emergency Pumps to Replace Existing Pumps that were Damaged when the Station was Flooded and which Jeopardized Public Health, Safety and Welfare Resolution #98-15 Resolution Authorizing Execution of Agreement with Allied Risk Management Services, 3 Cypress Point Lane, Monroe Township, NJ 08831 to Provide Risk Management Consulting Services Resolution #99-15 Resolution Authorizing Refund Payments Due to Tax Court Judgments Ordinances on Second and Final Reading Ordinance #2444-15 On motion made by Councilwoman McCartney and seconded by Councilman Guarino, AN ORDINANCE AMENDING CHAPTER 25, SECTIONS 51.16 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE (REVISION TO ZONING ORDINANCE), was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked if there was anyone who wished to make a statement at this time. There was no one who wished to be heard and the public hearing was closed. The Council had a brief discussion with regard to making changes to the language of this ordinance. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the motion on the above mentioned ordinance failed. 4

Ordinances on First Reading Ordinance #2445-15 AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEE SETTING FORTH THEIR TITLES, CLASSIFICATIONS AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL- ASST. SUPERVISOR/PUBLIC WORKS/CERTIFIED POOL OPERATOR – ASST. SUPERVISING MECHANIC – RECORDS SUPPORT TECH, SR. PUBLIC WORKS REPAIRER/PARKING METER COLLECTOR, was introduced and passed on first reading. The Clerk read the ordinance by title only. On motion made by Councilman Cirilo and seconded by Councilman Guarino, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on March 24, 2015. All members voting “Aye”. Ordinance #2446-15 AN ORDINANCE CREATING CHAPTER 2, SECTION 61 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE ENTITLED “PEDESTRIAN SAFETY ADVISORY BOARD” was introduced and passed on first reading. The Clerk read the ordinance by title only. On motion made by Councilwoman McCartney and seconded by Council President Guarino, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on March 24, 2015. All members voting “Aye”. Resolution #59-15 Resolution Authorizing the Appointment of Alicia Skinner t/a Skinner Consulting Services as the Township’s Grant Writer for a Fee of $2,333.33 Per Month for a Period of One Year Commencing on January 1, 2015 through December 31, 2015 Following discussion and on motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned resolution was adopted. Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney and Councilwoman Spango voting “Aye”. Councilman Krakoviak voting “Nay”. 5
Resolution #77-15 Resolution Authorizing the Execution of the First Amendment to the Agreement for Retention of the Municipal Prosecutor On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney and Councilwoman Spango voting “Aye”. Councilman Krakoviak voting “Nay”. ABC HEARING Misty’s Restaurant and Bar – License No. 0722-33-006-007 – Notice of Charges On motion made by Council President Guarino and seconded by Councilman Krakoviak, the Council adjourned as the Township Council and reconvened as the ABC Board. All members voting “Aye”. On motion made by Councilwoman Spango and seconded by Councilman Cirilo, the Council agreed to a two day suspension of the above named license as recommended and preapproved by the Criminal Investigative Division of the West Orange Police Department. Assistant Township Attorney Ken Kayser explained to the Licensee the ABC Board’s expectations and what her on-going responsibilities are going forward. All members voting “Aye”. On motion made by Council President Guarino and seconded by Councilwoman McCartney, the Council adjourned as the ABC Board and reconvened as the Township Council. All members voting “Aye”.
