1 Conference Meeting – January 17, 2017 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, and 66 Main Street, West Orange, New Jersey at 6:39 p.m. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk’s office on November 28, 2016 and published in the West Orange Chronicle on December 8, 2016. Roll Call: Present: Councilwoman Casalino, Councilman Cirilo, Councilman Guarino, Councilwoman McCartney and Council President Krakoviak. A presentation and public hearing was conducted by Bill Kehoe, Director of Parks and Recreation regarding the Multi Park Development/Improvements at Degnan and Lafayette Park(s). Mr. Kehoe explained the project to the Council and stated that it has received the support of the Open Space and Recreation Committee, the West Orange Hispanic Foundation represented by Mr. Rodolfo Rodriguez, the Mountain Top League represented by Mr. Peter Scalora, President, the WO PAL represented by Mr. Lou DePasquale and Mr. Joel Trose, Coach of the West Orange High School Girls Softball. Mr. Kehoe also said that other agencies in the community were in support of the project but did not attend the meeting this evening. The Council asked questions at this time of Mr. Kehoe and Mr. Gross and expressed support of the project. No one else wished to speak at this time. Jack Sayers gave an update on the Redevelopment on Main Street. 2 The Council responded at this time. *Review of Consent Agenda *Approval of Minutes of Previous Meeting The Executive Session minutes of December 20, 2016 and the Public Meeting minutes of January 3, 2017 were approved as submitted. *Resolution(s) adopted on Consent Agenda: a. 34-17 Resolution Authorizing the Township’s 2017 Green Acres Grant Application: Multi-park Development/Improvements at Degnan and Lafayette Park (Legal- Moon)(Rodriguez-Grant Writer) This grant is offered through the NJ Department of Environmental Protection, Green Acres Program to municipal governments for assistance in the acquisition, development and stewardship of lands for outdoor recreation and conservation purposes. b. 35-17 Resolution Authorizing the Issuance of Raffle Licenses (Clerk) c. 36-17 Resolution for Approval to Submit a Grant Application and Execute a Grant Contract with the New Jersey Department of Transportation for the Lessing Road Street Improvements Project (Lepore and Rodriguez-Grant Writer) d. 38-17 Resolution Authorizing an Award of Contract with Carrier Commercial Services, 100 Delawanna Ave., Clifton, NJ 07014, for the Replacement of the 40 Ton Carrier Rooftop HVAC Unit or Equivalent for the West Orange Public Library in the Amount of $59,975.00. (DeSantis) e. 39-17 Resolution Authorizing an Award of Contract with Stanziale Construction, LLC, P.O. Box 2597, Bloomfield, NJ 07003 for the Storm Sewer Replacement at 23 Maple Avenue in the Amount of $82,490.00. (Lepore) f. 40-17 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey (Gagliardo) On motion made by Councilman Cirilo and seconded by Councilman Guarino, the consent agenda was approved. All members voting “Aye.” Resolution(s) Removed from Consent Agenda Resolution 31-17 a. 31-17 Resolution Authorizing the Execution of a Professional Services Agreement with Richard D. Trenk, Esq., 347 Mt. Pleasant Avenue, West Orange, NJ to Continue to Serve as Municipal Attorney for the Township for the Period January 1, 2017 through December 31, 2017 at a Rate of $42,500. Per Year (Legal-Moon) On motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the above mentioned resolution was approved.
3 Councilwoman Casalino, Councilman Cirilo, Councilman Guarino and Councilwoman McCartney voting “Aye.” Council President Krakoviak voting “Nay.” Resolution 32-17 b. 32-17 Resolution Rescinding Previously Adopted Resolution 266-16 and Authorizing the Renewal of the Township’s Contract with Benecard for Prescription Drugs Benefit for a One Year Term Beginning January 1, 2017 through December 31, 2017 (Legal-Moon) The need to revise above referenced resolution follows the Mayor’s recusal from award and execution of agreements related to insurance for the Township. On motion made by Councilwoman McCartney and seconded by Councilwoman Casalino, the above mentioned resolution was approved. Councilwoman Casalino, Councilman Cirilo, Councilman Guarino and Councilwoman McCartney voting “Aye.” Council President Krakoviak abstained. Resolution 33-17 c. 33-17 Resolution Rescinding Previously Adopted Resolution 273-16 and Authorizing an Agreement with Fairview Insurance Agency Associates, Inc. for the Provision of Risk Management Consultation Services (Legal-Moon) The need to revise above referenced resolution follows the Mayor’s recusal from award and execution of agreements related to insurance for the Township. On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above mentioned resolution was approved. Councilwoman Casalino, Councilman Cirilo, Councilman Guarino and Councilwoman McCartney voting “Aye.” Council President Krakoviak voting “Nay.” Resolution 37-17 g. 37-17 Resolution Rescinding Previously Adopted Resolution 16-17 and Authorizing an Agreement with Allied Risk Management Services for the Provision of Risk Management Consultation Services (Legal-Moon) The need to revise above referenced resolution follows the Mayor’s recusal from award and execution of agreements related to insurance for the Township. On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above mentioned resolution was approved. The Council President asked if there was anyone who wished to be heard. No one wished to be heard. On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members present voting “Aye.” Ordinance 2502-17 On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-46.2, Parking Prohibited During Certain Hours of Certain Days on Certain Streets Servicing Residential Land Uses, Except by Permit of the Revised General Ordinances of the Township of West Orange was taken up on second and final reading. All members present voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Ronald Fahey – 10 Wilson Terrace No one else wished to be heard and the hearing was closed. On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members present voting “Aye.” Ordinance 2503-17 On motion made by Councilwoman McCartney and seconded by Councilman Guarino, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-37.1b, Municipal Parking Yards; Metered Parking, Permit Parking, Time Limited Parking, and Subsection 7-50.3h Parking Meters in Parking Yards, Prohibited Parking of the Revised General Ordinances of the Township of West Orange was taken up on second and final reading. All members present voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. 5 On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members present voting “Aye.” Ordinance(s) on First Reading Ordinance 2504-17 On motion made by Councilwoman McCartney and seconded by Councilman Guarino, An Ordinance Amending Chapter 2, Section 51 of the Revised General Ordinances of the Township of West Orange, Entitled “Human Relations Commission” was approved on first reading, ordered advertised according to law, to come up for second and final reading on February 7, 2017. All members voting “Aye.” Pending Matters/New Matters/Council Discussion The Council discussed the matter of the timing of the preparation and distribution of the Agenda and Meeting packets with an upcoming holiday. The issue of the graffiti and garbage on Rte. 280 in West Orange was discussed. At 8:38 p.m., on motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the meeting was adjourned. All members voting “Aye”.
