-92-1 PLANNING BOARD RESOLUTION GRANTING VARIANCES AS TO LOT COVERAGE, SET BACK AND PARKING AND CONDITIONALLY APPROVING THE AMENDED SITE PLAN APPLICATION AND NDITIONALLY APPROV. THE MINOR SUBDIVISION AP ATION BY_ BOW AND ARROW MANOR , LOCATED AT PROSPECT AVENUE, BEING BLOCK 151, LOTS 15, 15.02, 17.02, 17.04, & 17,06 AND BLOCK 151.03, LOTS 13, 205, 206. 207, 208, 209, 210, 210, & 211 Zz B-2 WHEREAS the Planning Board of the Township of West Orange, at its regular meetings held on January 6, 1993, February 3, 1993, March 3, 1993, April 14, 1993, and June 2, 1993, considered the application for a variance from the requirements of maximum lot coverage of 34.5% as limited by the steep slope section of the Zoning Ordinance, a minimum side yard of 125 feet on the north side, a minimum driveway set back of 50 feet, a minimum set back for the free standing sign of 50 feet and a minimum of 128 parking spaces for the Hotel as required by the West Orange Zoning Ordinance, which application was submitted by Bow and Arrow Manor, Inc., through their attorney, Robert C. Williams, Esq.; and WHEREAS the Planning Board considered the concurrent applications for amended site plan approval and minor subdivision approval; and WHEREAS the Planning Board considered the presentation of Robert C. Williams, Esq., Attorney for the applicant, and the testimony of Mr. Harry Knowles, for the Bow & Arrow, Inc., Mr. J. Michael Petry, P.E., the applicant’s project engineer, Mr. Joseph Courter, Mr. Jeffrey Hendricks, S.R.A. and Mr. Peter Steck, P.P., and Harold K. Maltz, P.E., the traffic engineer retained for the Township, and the various Exhibits A 1-A 13 that were placed in evidence; and WHEREAS the general public having been given an opportunity to be heard, the Planning Board made the following findings of fact: 1. The applicant is continuing an existing use on a portion of the site, and the applicant agreed that the occupancy limit of the Manor restaurant shall be 1,437. The current use has 572 parking spaces and the applicant will submit a joint parking agreement between the “Manor” and the “Hotel”.
2. The property, which is the subject of this application, has exceptional topographical conditions which uniquely affect its use. The excessive steep slopes occur around the perimeter of the existing parking lot and are toward the west. 3. The 80 foot side yard, as opposed to the 125 foot requirement to the north, will have no detrimental effect as the adjoining property to North is a golf course and there are no residential buildings there, other than one caretaker’s cottage. 4. Similarly 25 foot driveway set back, as opposed to the 50 foot requirement will have no detrimental effect as the adjoining property to North is a golf course, and the traffic expert believed that it would improve traffic safety and benefit the community to have the driveway in that location. 5. The addition of a fine hotel to match the ambiance of the restaurant will be a benefit to the Township. 7. The requested variances will not substantially impair the intent and purpose of the Master Plan and Zoning Ordinance of the Township of West Orange. The strict application of the regulations of the Zoning Ordinance would result in peculiar and exceptional practical difficulties to, or exceptional and undue hardship upon, the applicant without any similar benefit to adjoining property owners. NOW, THEREFORE, BE IT RESOLVED that, conditioned upon the approval of the Amended Site Plan Application and the Minor Subdivision Application for property located at Prospect Avenue, being Block 151, Lots 15, 15.02, 17.02, 17.04, & 17.06 and Block 151.03, Lots 13, 205, 206, 207, 208, 209, 210, 210, & 211, Zone B-2, in the Township of West Orange, the application for a variance from the requirements of maximum lot coverage of less than 40% as opposed to the 34.5% as limited by the steep slope section of the Zoning Ordinance, a minimum side yard of 80 feet as opposed to 125 feet required on the north side, a minimum driveway set back of 25 feet as opposed to 50 feet required, a minimum set back ( in line with the existing “Manor” sign) for ihe free standing sign as opposed to 50 feet required, and a minimum of 95 parking spaces as opposed to 128 parking spaces required for the Hotel, be and hereby is granted subject to the following conditions: 1.
