Assessment of Negative Criteria 1. No Substantial Detriment to Public Good ° The deck is designed to minimize its impact on neighbors, being predominantly screened by established trees and oriented toward the driveway and side wall of the adjacent property. This ensures privacy and limits visual exposure. © Construction will adhere to all safety and building standards and ordinances, ensuring it poses no hazard to the neighborhood. Improvement in Property Value e By increasing the usability and aesthetic appeal of the property, the deck will enhance the value of the home and contribute positively to the overall character of the local neighborhood. No Impairment of Zoning Ordinance’s Intent ¢ While the proposed deck encroaches six (6) additional feet into the required 30-foot setback per Ordinance 25-8.2, this modest variance will not undermine the zoning plan’s purpose of maintaining community harmony, privacy, or property value. © Due to the shape of the lot and the position of the house, there is limited visibility of the deck from adjacent properties, the difference in encroachment would be inconspicuous and unlikely to cause any adverse impact. ¢ The variance directly addresses the unique configuration of the property and is a reasonable accommodation to remedy the inherent hardship. The proposed deck represents a reasonable improvement that resolves a unique hardship, enhances the property's functionality, and aligns with the broader intent of the zoning regulations.
