Court West Orange, NJ, 07052 REASONS FOR RELIEF To the Members of the Zoning Board of Adjustment, | respectfully seek relief under N.J.S.A. 40:55D-70c, citing exceptional practical difficulties and undue hardship arising from the unique conditions of my property. The strict application of the Zoning Ordinance would present the following challenges: 1. Unique Property Conditions © Topographical Challenges: The first level of the home is elevated approximately four (4) feet three (3) inches above grade at the rear yard exit, making accessibility to the yard for recreation and entertainment impractical in its current state. ¢ Narrow Rear Yard: My property is situated on a corner lot with a narrow rear yard, significantly limiting the feasibility of an outdoor entertainment area. Together, these factors create a unique hardship that restricts the use and enjoyment of the rear yard. 2. Functional Necessity e The proposed deck, approximately 350 square feet in size, will provide direct access to the backyard and serve as the sole outdoor recreational space for the property. e Anarrower, 8-foot-wide deck—while conforming to the ordinance—would severely limit its usability, as it would not provide sufficient space for standard outdoor activities such as dining, grilling, seating, or hosting guests. e The 14-foot depth of the proposed deck is necessary to ensure it is both functional and proportional to the home’s size and layout, allowing for safe and practical use by family members and guests. ¢ This addition will address the lack of outdoor functionality, a feature that is both standard and expected for residential properties in the neighborhood. 3. Alignment with Zoning Intent e The deck design will respect the character of the community, avoids undue encroachment on neighboring properties, such as, with a substantial row of existing evergreen trees lining the yard, facing only the side and driveaway of the neighbor’s house, and overall enhances the general welfare by improving livability for current and future occupants. 1|Page REASONS FOR RELIEF Klein 7 Hims!
