Wolfe (NJ, NY & FL Bar) Via Fed-Ex and E-Mail (forester@westorange.org) Paula Sules, Clerk Township of West Orange Shade Tree Division 25 Lakeside Avenue West Orange, New Jersey 07052 RE: 262-270 Main Street Block 114, Lots 50 and 55 Tree Removal and Replacement Permit Application Dear Ms. Sules: We represent 262 Main Street Realty, LLC and 270 Main Street Realty, LLC, the owners of property located at 262-270 Main Street, which is designated as Block 114, Lots 50 and 55 on the Official Tax Map of the Township of West Orange (the “Property”). We recently submitted a land use application to the Planning Board and were advised that we had to complete the new Tree Removal and Tree Replacement Permit Application. By way of background, we are proposing to redevelop the existing site into a grocery store. Construction requires the removal of three (3) trees: Two (2) Pin Oaks and one (1) Sycamore Maple. In connection with the submission of the Tree Removal and Tree Replacement Permit Application, please find the following items: 1. Tree Removal Application; 2. Letter from Sam Burd, Licensed Tree Expert at Tamke Tree Experts dated November 21, 2025;

3. Tree Replacement Plan prepared by Jordan Cecinini, P.E., dated November 12, 2025, unrevised. The Tree Replacement Plan is designated as Sheet 5 of 12 of the Site Plan; 4. Shade Tree Details Plan, which includes Tree Protection Details, also prepared by Mr. Cecinini, dated November 12, 2025, unrevised. The Shade Tree Details Plan is designated as Sheet 6 of 12 of the Site Plan; 5. Soil Erosion and Sediment Control Notes and Details Plan, prepared by Mr. Cecinini, dated November 12, 2025, unrevised. The Soil Erosion and Sediment Control Notes and Details Plan is designated as Sheet 10 of 12 of the Site Plan; 6. $1,000 check payable to the Township of West Orange; and 7. 100 foot property owner’s list created December 3, 2025. The Checklist for Tree Removal Construction Applications/Projects includes a few checklist requirements (“Checklist Requirements”) that we respectfully request be waived for completeness purposes. First, we request that we be permitted to notice for the proposed tree removal in connection with the Planning Board application. Second, we request that we be permitted to submit the Hudson Essex Passaic Soil Conservation Approval as a condition of any potential Planning Board approval. As to the proposed notice, we can certainly insert additional notice language describing the proposed tree removal and replacement into the Municipal Land Use Law notice that is required for the Planning Board application. We have no objection to sending the notice to all of the neighbors within 200 feet (rather than 100 feet) because we will already have to mail the Municipal Land Use Law notice to all of those neighbors as part of the Planning Board application. If the Shade Tree Division prefers that we notice at a different time, please advise and we can do so. However, I do not think it would be appropriate for us to notice for the proposed tree removal before the Planning Board application is heard/decided. As to the required approval from the Soil Erosion Plan/Permit from the Hudson Essex Passaic Soil Conservation District, we request that same be required as a potential condition of any Planning Board approval. We certainly intend to file for this permit, but we intended to do so as part of the overall Planning Board application process. As part of the Planning Board application, we submitted a Soil Erosion and Sediment Control Notes and

this permit, but we intended to do so as part of the overall Planning Board application process. As part of the Planning Board application, we submitted a Soil Erosion and Sediment Control Notes and Details Sheet (included herewith), which includes a note stating that the TABLISHED 1929

Applicant “must obtain a District issued report of compliance prior to applying for the Certificate of Occupancy or a Temporary Certificate of Occupancy.” As such, we are already required to obtain the approval sought as part of the Checklist requirements. As to the balance of the Checklist Requirements, we confirm that we will install the tree protection measures depicted on the Shade Tree Details Plan, if same are acceptable to the Shade Tree Division. We further confirm that we intend to use Tamke Tree Experts to complete the tree work on the Property. We have also confirmed with Mr. Burd of Tamke Tree Experts that Tamke Tree Experts is currently registered in West Orange. Thank you for your consideration. If you require any additional information, please feel free to reach out! Very truly yours, C. Usage Amanda C. ‘ . soe , a New Jena Middlesex. PENNSYLVANTAY TAMKE oo sar | November 21, 2025 } To Whom It May Concern: The establishment of the three trees listed below at 270 Main Street in West Orange are not conducive to the construction project undertaken by 262 Main Street Realty in West Orange and must be removed to accommodate the projected scope of work. The root system(s) of the trees listed below also pose hazardous implications for the foundations of existing structures adjacent said trees. Lastly, the adjacent structures significantly limit the radius required to accommodate the growth of root plate(s) vital for anchoring the tree(s) to the ground. Said trees listed below: 4. Pin Oak (Quercus palustris) (30” Dbh) off of left rear corner of building adjacent 13 Erwin Place property line a. Proximity of root plate to adjacent structures (foundation of 13 Erwin Place and retaining wall) poses significant risk of damage to adjacent structures. b.
