By Resolution adopted April 17, 2024, and as reflected in the Notice of Decision published on April 25, 2024, the Township of West Orange Planning Board (the “Board”) approved the Developer’s application for conditional use approval, minor site plan approval, and bulk variance relief permitting the establishment of a Class 1 Cannabis Cultivation (Micro) facility within the Township’s Industrial (I) Zone. The approvals authorize utilization of 2,500 square feet of cannabis cultivation area within the existing approximately 9,335‑square‑foot warehouse building at the Property, together with associated site and operational improvements, subject to the terms and conditions set forth in the Resolution (collectively, the “Approvals”). Pursuant to N.J.S.A. 40:55D-46.1(c) and Township Code § 25-48.10(a), (c), and (h), the Developer hereby requests a one-year extension of the Approvals1. The Developer respectfully requests that this matter be scheduled for consideration at the Board’s upcoming April 15, 2026, regular meeting. Since obtaining the Approvals, the Developer has proceeded diligently and in good faith toward implementation of the project. Certain aspects of final permitting and construction were necessarily deferred to allow for the orderly review and resolution of a separate, contemporaneous application for development affecting the same Property, namely the application of Blue Violet 1 In accordance with the Ordinance, this request is timely filed prior to expiration, which occurs two (2) years and one (1) day from publication of the Notice of Decision, i.e., April 26, 2026, absent extension. That application involved related cannabis uses within a separate existing building on the Property and required coordination between the parties to ensure consistency between both approvals to avoid conflicting development rights, operational constraints, or site obligations applicable to the Property. To state the obvious, the Developer’s proceeding with final permitting steps for the project in advance of the resolution of Blue Violet’s application would have risked inconsistency with the Board’s conditions for the Approvals and potential regulatory inefficiencies, including duplicative or misaligned review by outside agencies and utility providers whose approvals are prerequisite to construction and occupancy. Now that the related Blue Violet Grow, LLC (PB‑25‑04) application has been approved in a manner consistent with the Approvals, the Developer is actively proceeding with finalizing permitting and implementation of the project. These efforts are now being undertaken in coordination with Blue Violet and applicable agencies and utilities to ensure compliance with the Board’s conditions governing the development and operation of the approved uses for the Property. For the reasons set forth above, good cause therefore exists for the requested extension. Enclosed for the Board’s administrative record are five (5) sets of the following documents: 1. Certification of Taxes Paid for Block 62, Lots 22.01, 32 and 34 (March 2026); 2. Affidavit of Publication: April 25, 2024, Notice of Decision; and 3. Affidavit of Service and Publication: April 15, 2026, Township of West Orange Planning Board virtual meeting. NOTICE OF PUBLIC HEARING (VIRTUAL MEETING ONLY) TOWNSHIP OF WEST ORANGE PLANNING BOARD PLEASE TAKE NOTICE that the Township of West Orange Planning Board (the “Board”), at its regular meeting to be held on Wednesday, April 15, 2026, at 7:30 p.m., will hold a public hearing by virtual format on the Zoom platform on the application of Yerrr Canna LLC (the “Applicant”) for a one-year (1) extension of prior approvals granted to Applicant by the Board, pursuant to N.J.S.A. 40:55D-12(a), and §§25-48.5 and 25-48.10(a) of the Township of West Orange Municipal Code. The prior approvals for which the one-year extension are sought were granted under Board Application Number PB-24-05, memorialized in a Resolution of approval adopted by the Board on April 17, 2024, and consisted of Conditional Use approval, C-2 bulk variance relief pursuant to N.J.S.A. 40:55D-70(c)(2), and minor site plan approval, for the operation of a Licensed Class 1 Cannabis Cultivator (Micro) in accordance with §25-14.2(b)(2)(0) of the Township Code. The subject property is located at 76-82 Ashland Avenue, 26 Patk Avenue, and 10 Park Avenue, and is identified on the official Tax Maps of the Township of West Orange as Block 62, Lots 22.01, 32, and 34 (the “Property”), located within the I-Industrial Zoning District, where Licensed Class 1 Cannabis Cultivators are a conditionally permitted use. ‘The prior approvals authorized the reuse of an existing two-story commercial building for cannabis cultivation purposes, together with limited site improvements, including employee parking areas (with ADA-compliant and electric-vehicle spaces), circulation and access controls, parking and pavement striping, fire and emergency access improvements, limited landscaping and lighting improvements, and installation of a generator subject to applicable noise standards. No expansion of the building footprint or increase in the intensity of the approved use was authorized under the prior approvals. The present application seeks only a one-year extension of time to maintain the validity of the previously granted approvals. No changes, amendments, or modifications to the approved use, plans, or conditions of approval are proposed under this application. A virtual meeting on said application will be held virtually before the Board on April 15, 2026, at 7:30 p.m., via the Zoom platform, at which time any interested
