By Resolution adopted April 17, 2024, and as reflected in the Notice of Decision published on April 25, 2024, the Township of West Orange Planning Board (the “Board”) approved the Developer’s application for conditional use approval, minor site plan approval, and bulk variance relief permitting the establishment of a Class 1 Cannabis Cultivation (Micro) facility within the Township’s Industrial (I) Zone. The approvals authorize utilization of 2,500 square feet of cannabis cultivation area within the existing approximately 9,335‑square‑foot warehouse building at the Property, together with associated site and operational improvements, subject to the terms and conditions set forth in the Resolution (collectively, the “Approvals”). Pursuant to N.J.S.A. 40:55D-46.1(c) and Township Code § 25-48.10(a), (c), and (h), the Developer hereby requests a one-year extension of the Approvals1. The Developer respectfully requests that this matter be scheduled for consideration at the Board’s upcoming April 15, 2026, regular meeting. Since obtaining the Approvals, the Developer has proceeded diligently and in good faith toward implementation of the project. Certain aspects of final permitting and construction were necessarily deferred to allow for the orderly review and resolution of a separate, contemporaneous application for development affecting the same Property, namely the application of Blue Violet 1 In accordance with the Ordinance, this request is timely filed prior to expiration, which occurs two (2) years and one (1) day from publication of the Notice of Decision, i.e., April 26, 2026, absent extension.
