79-25 February 25, 2025 Resolution WHEREAS, on May 16, 2023, the Township Council for the Township of West Orange (the “Township”) adopted Resolution No. 202-23 authorizing execution of a Contract for Food & Beverage Concession at West Orange Ginny Duenkel Pool Season with Fat Daddy’z (the “Contract”); and WHEREAS, on February 13, 2024, the Township Council for the Township of West Orange adopted Resolution no. 58-24 for the first extension of the contract, and WHEREAS, the Contract provides that the Township has the right to extend the Contract for an additional one-year period for summer 2025 whereby the Fat Daddy’z shall provide Pool Concession Services for 2025 and shall pay to the Township 25% of its total sales volume for providing such Pool Concession Services for 2025; and WHEREAS, the Township seeks to exercise the option to extend the Contract for an additional and final year. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE that the Township is authorized to exercise the second of the two (2) one-year extensions for the Contract consistent with the terms set forth therein; and be it further RESOLVED that the Township Clerk shall be authorized to forward an executed copy of this resolution to Fat Daddy’z as notice of the Township’s exercise of the second and final extension option.
