Hazardous Waste FE The Contractor, in coordination with the Engineer and/or representative, shall determine waste classification based on analytical results in accordance with applicable federal and state regulations. Waste classification is required only for soils that contain a waste and/or are going to be treated as a waste. Excavated soils are considered hazardous when the following criteria are met: 1) The soils test positive for characteristics of a hazardous waste defined at Title 40 Code of Federal Regulations (CFR) Part 261 Subpart C (261.21-261.24). 2) Is a listed waste as per 40 CFR Part 261 Subpart D (261.31-261.33). 3) Is a mixture of a solid waste (non-hazardous) and one or more hazardous wastes listed in 40 CFR Part 261 Subpart D (261.31-261.33). All excavated soils designated as hazardous waste (soils with contamination above the nonhazardous waste levels) must be properly staged and removed by the contractor from the excavation site within 28 days after receipt of waste characterization results, unless otherwise approved by the Engineer. Upon such Notification, additional regulatory requirements, including retention of an LSRP, may be required. 204.03 PRODUCTS (Reserved) A. 10-mil thick plastic sheeting shall be used as soil stockpile liner and covers, which shall cover a firm surface. All joints in the plastic sheeting shall overlap a minimum og 12-inches at the ends. Contractor may also use oll offs or gondolas lined with a minimum 10-mill plastic sheeting for the stockpiling of the materials, subject to the review of the Engineer and/or representative. B. Acontainment berm typically made up of hay bales and/or silt-fence shall be utilized around stockpiled soils to direct runoff and minimize erosion. 204.04 EXECUTION The Contractor shall notify the Engineer and/or representative one (1) week prior to the start of excavation of contaminated material. The Contractor shall be responsible for contacting regulatory agencies in accordance with the applicable reporting requirements. The Contractor shall immediately notify the Engineer upon encountering suspected contaminated material. Notification to regulatory agencies shall be coordinated by the Engineer or their representative. Surface water shall be diverted to prevent entry into the excavation. 204.05 WORK GUIDELINES Personal protective equipment should be utilized at all times during the removal debris. The Contractor shall ensure that all work involving the above referenced materials are conducted in accordance with the applicable local, State and Federal regulations. 204.06 DISPOSAL All materials, whether hazardous or non-hazardous shall be disposed of in accordance with all laws and provisions and all Federal, State, County, and local regulations. The Contractor shall ensure that all waste is properly characterized. The Contractor shall comply with the disposal requirements. The contractor shall submit waste facility applications and acceptance documentation, and fee payment requirements to the Engineer at least 15 days before planned removal of regulated material. Submit to the Engineer a bill of lading for each truckload of regulated material removed from the Project Limits. If the material being transported is classified as non-hazardous, it is legally considered a solid waste, (ID 27), and, as such, the transporter hauling the waste must be a New Jersey registered solid waste transporter in accordance with N.J.A.C. 7:26-1 et. seq. Soils destined for recycling or beneficial use are not considered ID 27 waste and thus, do not require registered transporters. All hazardous waste must be shipped in accordance with the U.S. Department of Transportation guidelines as stated in 49 C.RR. 171-179, N.J.A.C. 7:26-3.0 et seq., and contaminated soils material must be shipped in accordance with N.J. Solid Waste Regulations, applicable radioactive and medical waste regulations, and applicable local regulations, Hazardous waste shipments must be properly containerized, labeled, and manifested prior to leaving the site. All disposal transporters for regulated materials must be licensed by the appropriate regulatory agency or agencies to transport the type of waste being hauled. The transportation and maneuver of materials is expected to be completed in a safe and responsible fashion, in accordance with all local, State and Federal guidelines. The Contractor shall provide manifests for all materials sent to each respective disposal facilities. The Contractor shall obtain required federal, state, and local permits for excavation and storage of contaminated material. Permits shall be obtained at no additional cost to the Owner. The disposal of materials and debris is regulated under the Solid Waste Management Act (NJSA 13:1 E-1) and is governed by NJAC 7:26 et seq. The Contractor shall dispose of the material and debris according to the solid waste management plan developed by the solid waste management district of origin.

No payment will be made under this item for disposal of materials covered in other sections of the Contract Documents. No payment will be made for the disposal of the overlying hot mix asphalt. Disposing of contaminated soil will be measured by the ton. Payment shall not be made until the contractor has furnished the Engineer with a certificate from an approved recycling facility or a tipping certificate from an approved landfill. Payment will be made under: Item Pay Unit LOAD, HAULAND DISPOSE OF CONTAMINATED SOIL TON (IF AND WHERE ORDERED) No payment will be made for permits, fees, handling and transportation and any cost for same shall be included in the item for disposing of contaminated soil. No payment will be made for stockpiling and reuse of the excavated material. 26
No payment will be made for construction of stockpile areas. Any costs associated with aspects of grading, preparation, handling, placement, maintenance, removal, treatment, and disposal of stockpile cover materials and liner materials and all other items incidental to construction of stockpiles shall be included in the item for load, haul and dispose of contaminated soil. 27
DIVISION 300 — SUBBASE AND BASE COURSES SECTION 301 — SUBBASE AND BASE COURSES THE FOLLOWING IS ADDED: Subbase shall be constructed using existing on-site granular soils as approved and directed by the RE or Engineer. SECTION 302 — AGGREGATE BASE COURSE THE FOLLOWING IS ADDED: The Contractor shall submit as-built quantities with each payment invoice, each payment cycle. The sum of the quantities submitted for payment will be the measured quantity and the final contract quantity. It is the responsibility of the Contractor to review the as-built measurement with the RE prior to submitting the partial payment invoice. Individual/Separate payment for DENSE-GRADED AGGREGATE BASE COURSE shall not be made at pavement repair strips along curb-lines, beneath concrete sidewalks/driveways, beneath Hot Mix Asphalt Driveways, drainage pipe trenches, at set/reset castings or reconstructed drainage structures. Individual/Separate Payment for DENSE-GRADED AGGREGATE BASE COURSE shall only be made at locations of full depth reconstruction indicated on the plans or as directed in the field. Any other locations where Dense Graded Aggregate is specified or detailed as a bedding or backfill material shall be included in the various unit bid price items. All applicable unit bid price in this section shall include Excavation, Unclassified, pavement removal and disposal of all materials in order to construct the proposed improvements in accordance with the plans and specifications, including but not limited to DENSE-GRADED AGGREGATE BASE COURSE where full depth base repair or reconstructed road sections are indicated on the plans. THE FOLLOWING IS ADDED: Dense Graded Aggregate Base Course shall be place at the direction of the Engineer in areas where existing subbase material is unstable, or unsuitable for supporting the new pavement structure. 302.04 MEASUREMENT AND PAYMENT THE FOLLOWING ITEMS ARE ADDED: Item Pay Unit DENSE-GRADED AGGREGATE BASE COURSE, 6” THICK (IF AND WHERE DIRECTED) CUBIC YARD 28
DIVISION 400 — PAVEMENTS SECTION 401 — HOT MIX ASPHALT (HMA) COURSES 401.03 CONSTRUCTION 401.03.01 Milling A. Milling of HMA. THE LAST PARAGRAPH IS CHANGED TO: The time interval between milling of HMA surface and placing of new HMA overlay shall not exceed 72 hours. Shorter time interval requirements shall be as directed by the RE. All Roadways are to be swept after milling operations. There shall be no direct measurement and payment for sweeping roadways after milling. This work should be in included in other Pay items in the Contract. A pre-sweep at no additional cost to the Township will be performed prior to roadway overlay operations. 401.03.07 HMA Courses E. Spreading and Grading. THE FOLLOWING SUBPART IS ADDED: 3. Interface Between Proposed and Existing Pavement. Where new pavement is to abut with existing pavement, the existing pavement is to be sawcut full depth prior to any reconstruction. Where milling and overlay abut with existing pavement, the existing pavement is to be sawcut to the depth of the milling. The Contractor shall cut a neat, straight, vertical line using a pavement saw. The saw shall be a self-powered pavement saw with a diamond tipped circular blade. If the pavement to remain is damaged, it shall be repaired at the Contractor's expense. The Work shall include the cost of cleaning up, as well as any noise abatement procedures that might be required. There shall be no direct measurement and payment for sawing, joint adhesive, or tack coat, This work should be included in other Pay items in the Contract. THE FOLLOWING IS ADDED: THE TOWNSHIP WILL MEASURE HMA 9.5M64 SURFACE COURSE, AND HMA 19M64 BASE COURSE BY THE TON AS INDICATED ON THE CERTIFIED WEIGHT TICKETS, EXCLUDING UNUSED MATERIAL. AREAS UNNECESSARILY DISTURBED OR DAMAGED BY THE CONTRACTOR WILL NOT BE INCLUDED IN THE MEASUREMENT. All applicable unit bid price in this section shall include Excavation, Unclassified, pavement removal and disposal of all materials in order to construct the proposed improvements in accordance with the plans and specifications, including but not limited to HOT MIX ASPHALT __ SURFACE COURSE & HOT MIX ASPHALT __ BASE COURSE where base repair is indicated on the plans.
